Kauai Vacation Rental Condos: Where TVRs Are Still Legal

On Kauai, a condo can rent to visitors if it sits inside a Visitor Destination Area (VDA), or if it holds a grandfathered nonconforming use permit. Outside those, any rental shorter than 180 days is illegal. That one fact decides most of what a Kauai vacation rental condo is worth.

Where the Visitor Destination Areas are

Kauai’s VDAs are mostly the resort stretches of the coast:

  • Poipu. Condos and homes along Poipu Road east of the roundabout, down to the ocean.
  • Princeville. Most of the subdivision, with some exceptions near the entrance.
  • Kapaa and the Coconut Coast. Oceanfront condos and a few spot-zoned pockets near Coconut Marketplace.

There are no clean, fully accurate VDA maps. Boundaries follow parcel lines and some spots are irregular. Before you buy, confirm the exact parcel with the county or have your agent pull it.

Outside the VDA

Outside the VDA, Kauai doesn’t issue new vacation rental permits. The only legal ones are nonconforming use permits that existed before the county closed applications in 2008. The county publishes a list of these by tax map key. If a property isn’t on that list, it shouldn’t be renting short-term.

If you’re buying one of these, the permit has to come with it. The seller should hand over the original permit file, the latest renewal application, and the latest renewal letter. You then file an updated renewal within 30 days of recording.

Renewals are unforgiving

This is where Kauai owners lose permits. Renewals have to go to the Planning Department by certified mail at least two months before the due date. There’s no grace period and no reminder. Miss it and the county issues a cease-and-desist and forfeits the permit, and you can’t reapply. If you buy a permitted property, put the renewal date on your calendar the day you close.

Taxes on vacation rental income

Vacation rental income in Hawaii carries several taxes. Starting January 1, 2026, the state Transient Accommodations Tax is 11%. Counties add a 3% surcharge, and General Excise Tax is about 4.5% on Kauai. Altogether that’s roughly 18.5% of gross rent, before management, HOA dues, and insurance.

What to check before you buy

  • VDA status for the specific parcel, not just the neighborhood.
  • The building’s house rules. Some VDA condos still limit rentals through their own bylaws.
  • Permit history if the unit is outside the VDA, including every renewal letter.
  • Rental records. Ask for two or three years of income and occupancy, plus tax filings showing TAT and GET were paid.
  • Management. Many owners use an on-island manager, and you’ll need a local contact if you live elsewhere.

Is Kauai a safer bet than Maui?

For now, Kauai’s rules are stable. Maui is phasing out about 7,000 apartment-zoned vacation rentals over the next few years. Kauai has had its VDA system since 2008 and hasn’t moved to shrink it. A 2024 state law lets every county phase out rentals outside resort areas, though, so no island’s rules are guaranteed.
