Maui Bill 9: Is Your Condo Affected? Building-by-Building Status

Bill 9 ends nightly vacation rentals in most of Maui County’s apartment-zoned condos. The deadline is January 1, 2029 in West Maui and January 1, 2031 everywhere else. Some buildings may be rezoned into the new H-3 or H-4 hotel districts and keep renting by the night, but each one has to go through the Planning Commission and the County Council first.

This list starts from the county’s own list of apartment-district properties allowed to do short-term rentals (dated April 2022), plus a few properties named in later rezoning resolutions. Unit counts are from the county list. Rezoning and commission status comes from news coverage and published resolution lists, and we update it as votes happen. What the statuses mean

• Recommended for hotel rezoning: the Planning Commission recommended moving the property into a hotel district. The County Council still has to approve it.
• Recommended against rezoning: the commission recommended denial. The Council can still approve it, but it needs six of nine votes to go against the commission.
• Referred, awaiting commission: the Council sent the property to the commission and it hasn’t voted yet.
• Phase-out applies: the property is apartment-zoned and isn’t in an active rezoning batch that we know of. Nightly rentals end at the deadline.

Key dates

• Dec. 15, 2025: Bill 9 passes 5-3 and is signed the same day.
• June 22, 2026: Bill 88 takes effect, creating the H-3 and H-4 hotel districts.
• Sept. 22, 2026: The Maui Planning Commission reviews 48 properties and recommends approval for five.
• Sept. 29, 2026: The Council refers a second batch of 32 shoreline properties in Maalaea, Kihei and West Maui.
• Nov. 24, 2026: Deadline for the commission to return recommendations on the earlier referrals.
• Jan. 1, 2029: Nightly rentals end in affected West Maui buildings.
• Jan. 1, 2031: Nightly rentals end in affected buildings in the rest of the county.

If you own a unit

The real question for most owners is whether the unit still works as a long-term rental or an owner-occupied home once nightly rentals stop.
